The Site is an informational and marketing website providing information about Spaikz and its products. Our individual products and applications (for example, AudioShu) are provided under their own separate terms and agreements, which apply when you use those products.

2. Eligibility

You must be able to form a binding contract to use the Site. If you use the Site on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.

3. Acceptable use

You agree not to:

• Use the Site in any way that violates applicable law or regulation;

• Introduce malware or engage in any activity intended to harm the Site or its users;

4. Intellectual property

The Site and its content — including text, graphics, logos, the Spaikz name and marks, design, and code — are owned by Spaikz LLC or its licensors and are protected by intellectual-property laws. You may view and use the Site for your personal, non-commercial informational purposes. No other rights are granted, and all rights not expressly granted are reserved.

The Site may contain links to third-party websites and to our own products such as AudioShu. We do not control, and are not responsible for, the content, terms, or practices of third-party sites and services. Access to and use of any linked site or product is at your own risk and subject to that site's or product's own terms.

6. Communications

If you contact us through the Site (including via the contact form or by email), you are responsible for the accuracy of the information you provide. We may use your communications to respond to you and for related business purposes, as described in our Privacy Policy.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPAIKZ LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars (US $100).

9. Indemnification

You agree to indemnify and hold harmless Spaikz LLC and its owners, officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site or your violation of these Terms.

10. Governing law and venue

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in California, and you consent to their jurisdiction.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
